Terms and Conditions of NUTROLOGY LTD T/A GYMOLOGY AND GYMOLOGY ACTIVEWEAR LTD

Please read these terms and conditions carefully before ordering any products from our site or subscribing to one of our services. You should understand that by ordering any of our products or subscribing to one of our services, you agree to be bound by these terms and conditions.

Please tick the checkbox in the shopping basket to accept these terms and conditions. Please understand that if you refuse to accept these terms and conditions, you will not be able to order from our site.

 

Orders

After placing an order on our site, you will receive an e-mail from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that the product has been dispatched (Dispatch Confirmation). 

The subscription plan to our services consist of an initial charge and then followed by recurring period charges as agreed to by you. By entering into this agreement, you acknowledge that your subscription has an initial and recurring payment feature and you accept responsibility for all recurring charges prior to deactivation by yourself. gymologyuk.com will submit periodic charges (e.g. weekly) without further authorization from you, until you  terminate this authorization by stopping your subscripton service in your account or wish to change your payment method in your account. 

By subscribing to gymologyuk.com you are agreeing to pay recurring periodic subscriptions for an indefinite time until deactivated by you or us. You can deactivate your subscription at any time within the cut off deadline. You will not be charged for any deactivation. You can re-subscribe at any time following your deactivation, but we reserve the right not to permit re-subscription where we have previously elected to terminate a subscription by you.

Stopping your subscription is easy. You just need to go to your account area. We require a minimum of 5 working days to stop/pause/cancel orders due to cut off times.

Additional food preferences e.g. no broccoli, we will aim to meet this requirement where possible. This is not mandatory and is not to be used for allergies.


Food Delivery, Returns & Refunds

We aim to deliver on time i.e. (Sundays and Wednesdays). Factors out of our control occasionally prevent us from achieving this. We cannot accept liability for late delivery arising from conditions beyond our control.

If your delivery details change, you must update the courier as soon as possible. Once delivered to the given delivery address, the full product responsibility is yours.

Once the parcel has been delivered to your address and/or if you are not in, left at your door, safe place location or neighbour we hold no responsibility for the safety of the parcel.

We will not be responsible for any product that is damaged or faulty through your failure to store correctly.

We are not responsible for failure to deliver the parcel to the shipping address due to no-one being able to accept the delivery when a one hour time slot is issued prior to delivery.

We are not responsible or liable for your parcel if you have entered an incorrect address when ordering.

No re-delivery attempts will be made due to health & hygiene reasons.

We require 5 working days to pause or cancel any orders.

When you accept delivery if you find that any products are severly damaged or are in an unacceptable condition then you must inform us immediately and we shall inspect the product. Photographic evidence may also be requested in order for us to validate the claim.

At our discretion only if we find that the product delivered is not up to our usual standard, we will issue a new delivery.

Several types of goods are exempt from being returned unless requested by us. Perishable goods such as food, flowers, newspapers or magazines cannot be returned. As our products fall under Perishable – returns are exempt.

All refunds will be processed within 5 working days. Card refunds may take up to 10 business days for your bank to complete.

We require 5 working days to change, pause or cancel any orders.

We are not required to refund orders, only at our discretion where we see fit. A 5% refund charge may apply in certain cases.

 

Clothing Delivery, Returns & Refunds

All orders wil require a signature, at which point responsibility for your purchased goods passes to you.

If your delivery details change, you must update the courier as soon as possible. Once delivered to the given delivery address, the full product responsibility is yours.

​If you select for a neighbour to take delivery we hold no responsibility for the safety of the parcel.

We will not be responsible for any product that is damaged or faulty through your failure to store correctly.

When you accept delivery if you find that any products are severly damaged or are in an unacceptable condition then you must inform us immediately and we shall inspect the product. We shall ask for photographic evidence and for it to be returned to us for us to rectify.

Sometimes the fit isn’t right, so we’re happy to accept returns on any garment that is unworn and still fitted with all security tags and labels. This applies to any item despatched to us within 14 days of receipt by you.

We’re unable to accept returns beyond the 14 days of your receipt and anything sent to us after 14 days may be returned to you.

We can only accept your return if:

-Has the security ribbon attached

-Has all original packaging (including zip lock bag)

-Has not been worn, used or damaged

-Is not soiled by makeup, fake tan or deodorant or any markings

Shipping costs are not covered by us when returning, so we suggest using your local post office for the best service, tracking ID and signed for service and mark the outside of the package as Returned Goods and the value as low.

The returns sheet enclosed must be complete to indicate if you would like a refund or an exchange

Exchanges take up to 5 working days to process once received, plus the delivery time to your area.

One exchange per item is free, wherein we will send you the replacement item free of charge.

All refunds will be processed within 5 working days. Card refunds may take up to 10 business days for your bank to complete.

 

Factors Our Of Our Control

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations that is caused by events outside our reasonable control. Includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:

Strikes, lock-outs or other industrial action;


Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;


Fire, explosion, weather, storm, flood, earthquake, subsidence, epidemic or other natural disaster;
Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;


Impossibility of the use of public or private telecommunications networks; and


The acts, decrees, legislation, regulations or restrictions of any government.

Transfer Of Rights & Obligations

The contract between you and us is binding on you and us and on our respective successors and assignees.
You may not transfer, assign, charge or otherwise dispose of a contract, or any of your rights or obligations arising under it, without our prior written consent.

 

Allergens

Gymology Ltd cannot guarantee there will not be traces of the 14 key allergens listed by the Food Standards Agency in any of the meals. Gymology Ltd cannot ensure all allergen requests can be met. We are not a free from facility but will make every effort to cater. If you do have an allergen we would recommend that you do not consume our products.

 

Intellectual Property

We are the owner or the licensee of all intellectual property rights in our site, whether registered or unregistered, and in the material published on it. These works are protected by copyright laws and all such rights are reserved.
